Privacy Policy

Ecaterran S.A.S. ("Ecaterran", "we") is the controller of the personal data collected through ecaterran.com. This policy explains what data we process, for what purpose, on which legal basis, and your rights under Ecuador's Organic Law on Personal Data Protection (LOPDP), published in Official Registry Supplement 459 dated 26 May 2021, and its General Regulation.

1. Data controller

2. Data we process

Identification data (name, surname, ID card or passport), contact data (email, phone, address), financial data (bank account, in-platform loan history), navigation data (IP address, device type, cookies) and socio-economic data required for source-of-funds analysis.

3. Purpose and legal basis

We use your data to manage your registration, verify your identity in accordance with the Anti-Money Laundering Law, execute loan agreements, send information about new investment rounds (with your consent) and comply with our legal obligations towards the Superintendency of Companies, the UAFE and the SRI.

4. Retention

We retain your data for the duration of the contractual relationship and up to 10 years thereafter, in compliance with Ecuadorian anti-money-laundering regulation.

5. Recipients

We may share your data with the Superintendency of Companies, the UAFE, the SRI, judicial authorities, Ecuadorian banks, ICRE surveyors, notaries, property registries and technology providers under a data-processing agreement (hosting located in Ecuador and the United States under standard contractual clauses).

6. Data subject rights

You may exercise your rights of access, rectification, update, deletion, objection, portability, not to be subject to automated decisions and consultation by writing to dpo@ecaterran.com. You may also lodge a complaint with the Superintendency for the Protection of Personal Data of Ecuador.
